Judiciary Condemns Police Brutality, Pledges Impartial Justice in Ongoing Cases

The Judiciary has voiced deep concern over recent incidents of police brutality and violence during public protests, urging accountability and adherence to the rule of law. In a statement issued by Judiciary Spokesperson Hon. Paul Ndemo, the institution extended heartfelt condolences to the family of Albert Ojwang and wished a swift recovery to all those injured during recent demonstrations.

Ndemo acknowledged that the events of recent weeks have severely tested the conscience of the nation, warning against the disturbing rise in the infiltration of peaceful protests by violent elements.

“Such disruptions endanger lives and undermine the constitutional right to peaceful assembly,” he noted.

The Judiciary called on the National Police Service to fulfil its constitutional mandate by identifying, arresting, and prosecuting those responsible for inciting or committing acts of violence, including their sponsors.

With some of these incidents now before the courts, the Judiciary reaffirmed its commitment to dispensing justice in a timely, impartial, and independent manner. Ndemo emphasized that these proceedings will be handled within the framework of the law and constitutional principles.

He further clarified that, globally, judges and even Chief Justices are bound by ethical standards not to comment on matters likely to come before the courts, in order to preserve judicial independence and impartiality.

“This is precisely why the Office of the Judiciary Spokesperson exists  to engage the public without compromising ongoing or potential judicial processes,” he explained.

The Judiciary urged the public to remain calm and trust in the justice system, reiterating its unwavering commitment to upholding justice and protecting the constitutional rights of all Kenyans.
