Heavy Police Presence Ahead of High-Stakes Judgment
Security was significantly heightened outside Milimani Law Courts on Monday as Kenya awaited a landmark ruling in the impeachment case involving former Deputy President Rigathi Gachagua. The highly anticipated judgment has drawn national attention, prompting authorities to deploy additional security personnel amid fears of large crowds gathering at the court premises.
Anti-riot police officers were stationed around the court compound from the early hours of the morning, while security teams conducted thorough screening of visitors entering the facility. Court officials said the enhanced security measures were informed by intelligence reports indicating that supporters of the former deputy president could converge at the venue in large numbers, potentially creating security challenges.
The atmosphere around the court remained tense but orderly as Kenyans, political leaders, legal experts and supporters of both sides awaited the outcome of a case that could have significant political and constitutional implications.
Three-Judge Bench to Determine Fate of Impeachment
At the center of the closely watched proceedings is a three-judge bench comprising Justices Eric Ogola, Anthony Mrima and Frida Mugambi. The judges are expected to deliver their long-awaited decision nearly 20 months after Gachagua was impeached by the Senate.
The ruling will determine whether the court upholds the Senate’s decision to remove Gachagua from office or overturns the impeachment on constitutional and legal grounds.
The former deputy president has challenged the impeachment process, arguing that it violated his constitutional rights and failed to meet the legal threshold required for the removal of a deputy president from office. According to his petition, the proceedings were flawed and denied him a fair hearing, rendering the entire process unlawful.
Legal analysts have described the judgment as one of the most significant constitutional decisions in recent years due to its potential impact on future impeachment proceedings and the interpretation of constitutional safeguards for public office holders.
Gachagua Maintains Confidence in Judiciary
Despite the uncertainty surrounding the verdict, Gachagua has publicly expressed confidence in the judicial process and indicated that he is prepared for any outcome.
Speaking on Sunday ahead of the ruling, the former deputy president said he remained optimistic that justice would prevail. He stated that if the court found that the impeachment process was unfair and unconstitutional, it would reinforce public confidence in Kenya’s justice system.
“We are ready for whatever outcome. If the judges rule that we were treated unfairly and against the law and the Constitution, we shall be grateful that there is a justice system in Kenya that works,” he said.
Although Gachagua has abandoned efforts to seek reinstatement to office, he continues to pursue compensation and damages for what he describes as an unlawful and unconstitutional process that led to his removal.
Appeal Option Remains Open
The former deputy president also made it clear that a decision against him would not mark the end of the legal battle. He said he would move to the Court of Appeal to challenge any unfavorable verdict.
“If the ruling goes the other way, it is still okay. We will still have an opportunity to go to the Court of Appeal and follow the legal remedies provided by the Constitution,” he noted.
His remarks underscore the possibility that the legal contest could continue beyond the High Court regardless of Monday’s outcome.
Call for Peace and Restraint
As anticipation intensified, Gachagua appealed to his supporters to remain peaceful and respect the rule of law. He urged them to avoid demonstrations, confrontations or any actions that could disrupt public order following the court’s decision.
“I ask my supporters to suppress their anger because we are peaceful people and we believe in doing things peacefully,” he said.
The appeal came amid heightened concerns over possible reactions from supporters depending on the outcome of the case.
With security tightened and the nation watching closely, the judgment is expected to mark a defining moment in Kenya’s political and constitutional landscape. Whether the court upholds or overturns the impeachment, the ruling is likely to shape future debates on accountability, due process and the limits of political power in the country’s governance system.
